General sales conditions

Article 1: General provisions

By accessing and using the website, the visitor and / or customer expressly agrees to the following General Terms and Conditions ("conditions") that apply to any order placed by a visitor to this website ("customer") at Wilderen Brewery & Distillery. Placing an order via the webshop of Brewery & Distillery Wilderen means that the customer has consulted the conditions and explicitly accepts their application, to the exclusion of all other conditions. Additional provisions on the part of the customer are excluded, unless they have been accepted in advance, in writing and explicitly by Brewery & Distillery Wilderen.

Intellectual property rights

The content of this site, including the brands, logos, drawings, data, product or company names, texts, images, etc., are protected by intellectual rights and belong to Brewery & Distillery Wilderen or entitled third parties.

Limitation of Liability

The information on the website is of a general nature, is not adapted to personal or specific circumstances and can therefore not be regarded as personal, professional or legal advice to the user. 

Brewery & Distillery Wilderen makes every effort to ensure that the information provided is always complete, correct, accurate and up-to-date. Despite these efforts, inaccuracies may nevertheless occur in the information provided. If the information provided contains errors or if certain information is not available on or via the site, Brewery & Distillery Wilderen will make every effort to rectify it as soon as possible.

Brewery & Distillery Wilderen cannot, however, be held liable for direct or indirect damage resulting from the use of the information on its site.

If you should find inaccuracies on the site, you can always contact the site administrator.

The content of the site (including links) can be adapted, changed or supplemented at any time without notice or notification. Brewery & Distillery Wilderen does not guarantee the proper functioning of the website and can in no way be held liable for the malfunctioning or temporary (un) availability of the website or for any other form of damage, direct or indirect, that would arising from access to or use of the website. 

Brewery & Distillery Wilderen cannot be held liable under any circumstances and / or towards anyone, directly or indirectly, in any special or other way, for damage that is attributable to the use of this site or of another as a result of links or hyperlinks, including without limitation, of all losses, work interruptions, damage to systems or other data of the user's computer system, equipment, software, etc. 

The website may contain hyperlinks to websites or pages of third parties or refer to them indirectly. Placing links to these websites or pages does not imply endorsement of their content in any way. 

Brewery & Distillery Wilderen explicitly declares that it has no control over the content or other characteristics of these websites and can under no circumstances be held liable for the content or characteristics thereof, nor for any other form of damage resulting from their use.

Applicable law and competent courts.

Belgian law applies to this site. In the event of a dispute, only the courts of the district of Hasselt have jurisdiction (see also Article 16).

Article 2: Price

All prices quoted are expressed in EURO, always including VAT and all other taxes - obligatory to be borne by the customer. If delivery, reservation or administration costs are charged, this will be stated separately. 

The quotation only refers to the articles as described verbatim. The accompanying photo is intended to be illustrative but may contain elements that are not included in the price.

Article 3: Offer

The items are exclusively intended for normal private use and for customers over 18 years of age on the day of purchase and delivery. 

Despite the fact that the catalog and website were and are being compiled with the greatest possible care, it is always possible that the information provided is incomplete, contains material errors or is not recent. Obvious mistakes or errors in the offer are not binding for Brewery & Distillery Wilderen. As far as the correctness and completeness of the information provided is concerned, the case is only bound by an obligation of means. Brewery & Distillery Wilderen is in no way liable for material errors such as typesetting or printing errors. 

If you have specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request that you contact our customer service in advance (see article 12). 

The offer is valid while stocks last and can at any time be adjusted or withdrawn by Brewery & Distillery Wilderen, which cannot be held liable for the unavailability of a product. 

Article 4: Online purchases

All purchases must be made via the website of Brewery & Distillery Wilderen. Please follow the ordering instructions on the screen.  

The articles are delivered to the customer's home or via another agreed delivery method (see article 7) on the delivery date indicated in the confirmation email. 

Brewery & Distillery Wilderen is entitled to refuse an order (in writing) on ​​the basis of a serious shortcoming by the customer with regard to the order or any other order or agreement in which the customer is involved. 

Article 5: Retention of title

The delivered items remain the exclusive property of Brewery & Distillery Wilderen until full payment has been made by the customer .   

However, the risk of loss or damage passes to the customer upon delivery. The latter undertakes, if necessary, to inform third parties of the retention of title of Brewery & Distillery Wilderen, for example to persons who would seize items that have not yet been fully paid for.  

Article 6: Sanctions for non-payment

Without prejudice to the exercise of other rights that Brewery & Distillery Wilderen has, in the event of non-payment or late payment from the date of the default, the customer owes an interest of 10% per year on the unpaid amount by operation of law and without notice. In addition, the customer is legally obliged to pay a flat-rate compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.   

Without prejudice to the foregoing, Brewery & Distillery Wilderen reserves the right to take back items that have not been paid (in full). 

Article 7: Delivery

For our delivery we work together with an external company. Delivery can take 3 to 7 working days after receipt of your payment . 

Article 8: Warranty

  • Legal warranty (only for consumers)

According to the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each item is subject to the legal warranty from the date of purchase by (possibly: delivery to) the first owner. These rights remain unaffected by any other commercial guarantee.

  • General

To be able to invoke the warranty conditions, the customer must be able to present the proof of purchase. 

For articles purchased online and delivered to the customer's home, the customer must contact the Brewery & Distillery Wilderen customer service in advance, after which the customer must return the article at his expense.  

Any defect must be reported by the consumer within a period of 2 months after receipt of the product. Afterwards, any right to repair or replacement will lapse. 

The (commercial and / or legal) warranty never applies to defects that have arisen as a result of accidents, neglect, abnormal or incorrect use of the article, non-compliance with the instructions for use or manual, adjustments or changes to the product or bad maintenance. 

Nor does it apply to articles with a short (er) lifespan or wear articles.

Defects that manifest themselves after a period of 6 months following the purchase date or possibly the delivery date, are considered not to be hidden defects, unless proof to the contrary by the customer. 

The warranty is non-transferable. 

Article 9: Right of withdrawal

The provisions of this article only apply to customers who purchase articles online in their capacity as consumers.

The consumer has the right to inform Brewery & Distillery Wilderen that he is renouncing the purchase, without payment of a fine and without giving any reason within 14 days from the day following the delivery of the product.   

Customers who wish to make use of the right of withdrawal must contact the Brewery & Distillery Wilderen customer service within the aforementioned period of 14 days and return the goods to Brewery & Distillery Wilderen - Wilderenlaan 8 at their expense within 20 days from the delivery date. , 3803 Sint-Truiden (Wilderen)  

Goods with a sales price of 100 Euro or more must be returned by courier (DHL, Fedex, etc.).

The customer may not use the products during the withdrawal period. If the returned product turns out to be damaged or in any other way reduced in value, Brewery & Distillery Wilderen reserves the right to claim compensation for any depreciation due to the customer. 

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase, can be taken back. 

Unless otherwise agreed, the customer cannot exercise the right of withdrawal for agreements:

  1 ° regarding the provision of services, the performance of which has begun with the consent of the customer before the end of the withdrawal period; 

  2 ° regarding the delivery of goods that are manufactured according to the customer's specifications, that have a clearly personal character, that cannot be returned due to their nature or that can quickly deteriorate or become obsolete; 

  3 ° regarding the delivery of audio and video recordings and computer software of which the seal has been broken by the customer. 

Article 10: Privacy

Brewery & Distillery Wilderen attaches great importance to your privacy.   

In case the user of the website is asked for personal information, the following provisions apply:

- the person responsible for processing, Brewery & Distilleerderij Wilderen - Wilderenlaan 8, 3803 Sint-Truiden (Wilderen) respects the Belgian law of 8 December 1992 with regard to the protection of privacy when processing personal data; 

- the personal data you provide will be used for the following purposes: our customer management, order processing, sending newsletters, providing information about our activities, our advertising and / or marketing purposes and the like;

- you always have a legal right to inspect and, if necessary, correct your personal data. Subject to proof of identity (copy of identity card), you can obtain a written record of your personal data free of charge via a written, dated and signed request to Brewery & Distillery Wilderen. If necessary, you can ask for data to be corrected that is incorrect, incomplete or irrelevant;

- your personal data will under no circumstances be passed on, rented or sold to third parties;

- you are responsible for keeping your log-in data confidential and for the use of your password. The latter is stored encrypted and Wilderen Brewery & Distillery has no access to it.

- Brewery & Distillery Wilderen can collect anonymous or aggregated data of a non-personal nature, such as browser type or IP address, the operating system you use or the domain name of the website that led you to the Brewery & Distillery Wilderen website, or through which you leave our site. This makes it possible for us to permanently optimize the Wilderen Brewery & Distilleerderij website for our users

Article 11: Use of cookies

During a visit to our site, 'cookies' may be placed on the hard drive of your computer. A cookie is a text file that is placed by a website server in the browser of your computer or on your mobile device when you visit a website. Cookies cannot be used to identify persons, a cookie can only identify a device. We mention:

Article 12: Infringement of validity - non-renunciation

If any provision of these terms and conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. 

Failure by Brewery & Distillery Wilderen at any time to enforce one of the rights listed in these terms and conditions, or to exercise any right thereof, will never be seen as a waiver of such provision and will never validity of these rights.

Article 14: Change of conditions 

The general terms and conditions of sale of Brewery & Distillery Wilderen can be supplemented with other provisions to which explicit reference is made. In case of contradiction, the former clauses prevail. Brewery & Distillery Wilderen can change these at any time without further notice. Any purchase after such change constitutes acceptance by the customer of these new terms. 

Article 15: Evidence

The customer accepts that electronic forms of communication and backups can serve as evidence. 

Article 16: Applicable law - Competent court 

Belgian law is applicable, with the exception of the provisions of private international law regarding the applicable law and the clauses of the Rome I regulation in connection with international sales contracts for movable property. In the event of disputes, only the Court in Antwerp, Hasselt department, have jurisdiction (companies) and the Justice of the Peace in Sint-Truiden (consumers).
